Montana TikTok Ban Doesn’t Infringe Free Speech, State Says

Montana asked a federal court to allow its statewide TikTok ban to take effect, arguing that the ban was a legitimate exercise of the state’s police power and a valid response to concerns that the social media app funnels users’ personal information to the government of China.

The TikTok ban, SB 419, doesn’t implicate the First Amendment because its goal it to prevent harm to consumers, not restrict expressive activity enabled by the app, the state said in a brief filed Aug. 18 in the US District Court for the District of Montana.
