Government Delays Require Cutting $33 Million Medicare Fraud Win

A jury properly found that the operators of a Mississippi hospital violated the False Claims Act by overbilling Medicare, but the $33 million trebled recovery must be reduced “by over half” for the government’s delay in the case, the Fifth Circuit ruled Monday.

The verdict against Corporate Management Inc. and others in 2020 was justified because the government met its materiality burden under the FCA, Judge Cory T. Wilson of the US Court of Appeals for the Fifth Circuit said.
