A federal district court in North Carolina granted Anthem Blue Cross Blue Shield and Deloitte LLP Group Insurance Plan’s partial motion to dismiss an employee’s claim for equitable relief related to alleged violations of the Mental Health Parity Addiction Equity Act. The employee’s beneficiary was denied benefits for residential treatment at a long-term treatment program for various behavioral problems. According to the court, the employee has a cause of action against the plan directly under ERISA.
